Introduction

This Privacy Policy applies to Boom Collaboration, LLC., its affiliates, operating divisions, branches, and subsidiaries, which may be referred to as “Boom,” “Boom Collaboration,” “Boom UCC,” “we,” or “us.” This Privacy Policy explains our online and offline information practices, the kinds of information we may collect, how we intend to use and share that information, and how you (“you” includes the user, consumer, purchaser, prospective customer, or the like) can opt-out of a use, correct, or change such information. All terms are defined in Section 13 or otherwise herein.

Scope

This Privacy Policy applies to Personal Information that is Processed by Boom in the course of our business including on www.boomcollaboration.com , www.boomucc.com websites (each a “Site” or “Sites”), mobile applications, forums, blogs, and other online or offline offerings (together with any online and offline offerings operated by or on behalf of Boom, the “Service” or “Services”) and the software and hardware we sell or license to you (the “Products”). This Privacy Policy is incorporated into the Terms of Service. All individuals whose responsibilities include the Processing of Personal Information on behalf of Boom are expected to protect that data by adherence to this Privacy Policy. This Privacy Policy is intended to meet requirements globally, including those in North America, or Europe

In certain instances, we may act as either a Controller or Processor of Personal Information. Please see Section 11 on how to receive additional information, here.

How We Collect and Use Personal Information

The types of Personal Information we may collect (directly from you or from Third-Party sources) and our privacy practices depend on the nature of the relationship you have with Boom and the requirements of applicable law.

We endeavor to collect only that information which is necessary for a business purpose and relevant for the purposes of Processing. Below are the ways we collect Personal Information and how we use it.

3.1

Type of Personal Information We Collect

Boom collects Personal Information regarding its current, prospective, and former clients, customers, users, visitors, and guests (collectively “Individuals”).

Information You Provide Directly to Us. When you use the Services, Products, or engage in certain activities, such as registering for an account with Boom, responding to surveys, requesting Services or information, or contacting us directly, we may ask you to provide some or all of the following types of information:

Account Creation. To purchase Products and to obtain other Services offered on the Sites, you may have to register an account by completing a questionnaire online. Through the completion of the questionnaire we typically collect the following information: (i) full name; (ii) address; (iii) email address; (iv) credit card information; (v) password; and (vi) nickname or on-line identifier. This Personal Information is required and if you choose not to submit the requested information, we may not be able to provide you with the Products or Services offered on the Sites.

You may access the Sites without being a registered user. However, you may not be able to access certain areas or purchase our Products or Services online if you are not a registered online user.

Product Registration. To register your Product, we may request the following information: (i) name; (ii) email address; (iii) physical address, (iv) phone number, (v) product serial number, and (vi) purchase date.

Partner Applications. To become a Boom Partner, which includes a Boom reseller, distributor, or channel partner, or to engage in another similar relationship with Boom, you must complete an online application. By virtue of our online application we may collect Personal Information such as your (i) name, (ii) title and function, (iii) company name, (iv) physical address, (v) phone number, and (vi) email address. The provision of the requested information is required for users who want to become Boom Partners.

Promotions, Contests, and Sweepstakes. From time-to-time we may sponsor voluntary promotions, contests, or sweepstakes on a Site. Your voluntary participation may include our request for your Personal Information, which may include information such as name, email address, phone number, company name, and physical address, as well as demographic information (such as zip code). Our promotions, contests, or sweepstakes may additionally offer you the option to choose whether you want to receive certain additional special promotions from Boom and its advertisers, affiliates, and sponsors, or a Boom Partner (see Section 5 for more information, here). Where a promotion, contest, or sweepstakes is not sponsored by Boom, the identity of the sponsor will be clearly disclosed in the rules. Boom’s Privacy Policy does not apply to activities on Third-Party or Third-Party Partner websites, including sponsors. We encourage you to review the privacy policy of the Third-Party, Third-Party Partner, or sponsor before entering.

Public Forums. Our Site offers publicly accessible blogs, forums, and user reviews. You should be aware that any information you provide in these public forums may be read, collected, and used by others who access them. To request removal of your Personal Information from these areas, contact us at admin@boomcollaboration.com. In some cases, we may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so and why.

Online Surveys. If you desire, you may participate in Boom’s online surveys. If you choose to participate, we may collect information about the environment you work in, telephone habits, and demographic information, for example. These surveys are developed in order for us to understand what types of Products are most effective for our customers and to find the best ways to advertise to reach new customers. Your participation in our online surveys is entirely voluntary. Boom may provide gifts to those individuals who participate in surveys and will request a mailing address to ship the gift. In addition to sending you a gift, Boom may use your mailing address or other Personal Information for the purposes set out in the survey, for marketing purposes, to improve our product, or for other legitimate business purposes. You will be given the option to opt-in to receive further emails from Boom, including but not limited to marketing emails, advertisements, newsletters and bulletins.

Online Support. When you choose to use the online chat tool for support, the following information may be gathered through the creation of an account or use of an existing account: email address, password, name, company name, physical address, phone number, and Device information including Product model serial number, and manufacturer. The shared information, with the exception of the password, is viewable to the support person handling the chat. You will be given the option to opt-in to receive further emails from Boom, including but not limited to, marketing emails, advertisements, newsletters and bulletins. Staying in Touch. Boom may communicate with you via physical mailings, emails, phone calls, and SMS messages in accordance with your communication preferences. You can opt-out of these communications at any time by following the instructions under Section 5, here.

Data We Collect Automatically. We may collect certain information automatically through our Services or other methods of web analysis, such as your Internet Protocol (IP) address, cookie identifiers, mobile carrier, mobile advertising identifiers, MAC address, IMEI, Advertiser ID, mobile applications actually used to interact with Boom, and other Device identifiers that are automatically assigned to your computer or Device when you access the Internet, browser type and language, geo-location information, hardware type, operating system, Internet service provider, pages that you visit before and after using the Services, the date and time of your visit, the amount of time you spend on each page, search activity, information about the links you click and pages you view within the Services, and other actions taken through use of the Services such as preferences. Information from Other Sources. We may collect or receive information about you from other sources, including through Third-Party services and organizations, including Third-Party Partners, to supplement information provided by you. This supplemental information allows us to verify information that you have provided to Boom and to enhance our ability to provide you with information about our business, Products, and Services.

3.2

How Boom Uses Your Personal Information/ Business Purpose

We may use the Personal Information we collect for some or all of the following business purposes:

Auditing related to a current interaction with you and concurrent transactions, including but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with privacy laws, this privacy policy, and other standards.

Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.

Debugging to identify and repair errors that impair existing intended functionality.

Short-term, transient uses, provided the Personal Information is not disclosed to another Third-Party and is not used to build a profile about a consumer or otherwise alter an individual consumer’s experience outside the current interaction, including, but not limited to, the contextual customization of ads shown as part of the same interaction.

Performing Services, including maintaining or servicing accounts, providing customer Service, Processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing advertising or marketing Services, providing analytic Services, or providing similar Services.

Undertaking internal research for technological development and demonstration.

Undertaking activities to verify or maintain the quality or safety of a Service or Device that is owned, manufactured, manufactured for, or controlled by Boom, and to improve, upgrade, or enhance the Service or Device that is owned, manufactured, manufactured for, or controlled by Boom.

3.3

Legal Basis for Processing Personal Information (EEA visitors only)

If you are a visitor from the EEA, our basis for collecting and using your Personal Information will depend on the Personal Information concerned and the specific context in which we collect it.

We may collect information from you in the following ways: (i) with your consent; (ii) in order to perform our contractual obligations with you; (iii) where Processing of the information is within our legitimate business interests and such business interest is not overridden by your data protection interests or fundamental rights and freedoms; or (iv) in order to perform our legal obligations or to protect your vital interests or the vital interests of another. If legally permissible, we will inform you that we are collecting your Personal Information and whether the collection of the information is mandatory or not, including the possible consequences if you do not provide the information requested (e.g., our inability to perform certain requests).

Opting-Out and Product White Paper Information

Even if you have opted-in to sharing your Personal Information, you may opt-out at any time by following the procedure in Section 5, here. To view the categories of Personal Information collected, the categories of sources from where Personal Information is collected, the business purpose for collecting the information, or the categories of Personal Information disclosed to Service Providers please write to admin@boomcollaboration.com.

Cookies, Pixel Tags/Web Beacons, Analytics Information, and Interest-Based Advertising

We, as well as Third-Party Partners that provide content, advertising, or other functionality on our Services, may use cookies, pixel tags, local storage, and other technologies (“Technologies”) to automatically collect information through the Services. We use Technologies that are essentially small data files placed on your computer, tablet, mobile phone, or other similar device (“Devices”) that allow us to record certain pieces of information whenever you visit or interact with our Sites, Services, applications, messaging, and tools, and to recognize you across Devices.

Cookies, GIFs, and HTML5. We, and our Third-Party Partners, use cookies, scripts, and tags on our Sites. A cookie is a piece of data stored on a website visitor's hard drive to help us improve your access to our Sites and identify repeat visitors to our Sites. Cookies can also enable us to track and target the interests of our users to enhance the experience on our Sites. Additionally, we use cookies to track our online advertising efforts. If you wish to not have this information used for the purpose of serving you interest-based ads, you may opt-out by clicking here (or if you are located in the European Union, please click here). Please note this does not opt you out of being served untargeted ads.

Our Third-Party Partners may also use other tracking technologies, such as clear GIFs (a.k.a. web beacons/web bugs), that help us better manage content on our Sites by informing us what content is effective. Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users.

We also use clear GIFs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If you would like to opt-out of these e-mails, please see Section 5.

We, and our Third-Party Partners, use Local Shared Objects (Flash cookies) or Local Storage (HTML 5), to store content information and preferences. Social Media Features and Widgets. Our Sites includes social media features, such as the Facebook Like button and widgets, such as the "Share This" button or interactive mini-programs that run on our Sites. These features may collect your IP address, which page you are visiting on our Sites, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a Third-Party Partner or hosted directly on our Sites. Your interactions with these features are governed by the privacy policy of the company providing it.

Analytics. We may also use Google Analytics and Google Analytics Demographics and Interest Reporting to collect information regarding visitor behavior and visitor demographics on some of our Sites and Services, and to develop website content. You can opt-out of Google’s collection and Processing of data generated by your use of the Services by going to http://tools.google.com/dlpage/gaoptout.

Our uses of such Technologies fall into the following general categories and meet a legitimate business purpose: Operationally Necessary. We may use cookies, web beacons, or other similar technologies that are necessary to the operation of our Sites, Services, applications, and tools. This includes technologies that allow you access to our Sites, Services, applications, and tools; that are required to identify irregular Site behavior, prevent fraudulent activity and improve security; or that allow you to make use of our functions such as shopping-carts, saved search, or similar functions.

Performance Related. We may use cookies, web beacons, or other similar technologies to assess the performance of our Sites, applications, Services, and tools, including as part of our analytic practices to help us understand how our visitors use our Sites, determine if you have interacted with our messaging, determine whether you have viewed an item or link, or to improve our Site content, applications, Services, or tools.

Functionality Related. We may use cookies, web beacons, or other similar technologies that allow us to offer you enhanced functionality when accessing or using our Sites, Services, applications, or tools. This may include identifying you when you sign into our Sites or keeping track of your specified preferences, interests, or past items viewed so that we may enhance the presentation of content on our Sites.

Advertising or Targeting Related. We may use first-party or Third-Party Partner cookies and web beacons to deliver content, including ads relevant to your interests, on our Sites or on Third-Party Partner websites. This includes using technologies to understand the usefulness to you of the advertisements and content that has been delivered to you, such as whether you have clicked on an advertisement.

If you would like to opt-out of the Technologies we employ on our Sites, Services, applications, or tools, you may do so by blocking, deleting, or disabling them as your browsers or Devices permit.

3.6

Third-Party Websites, Social Media Platforms, Software Development Kits

The Sites may contain links to other websites and other websites may reference or link to our Sites or other Services. These other domains and websites are not controlled by us, and Boom does not endorse or make any representations about Third-Party or Third-Party Partner websites or social media platforms. We encourage our users to read the privacy policies of each and every website and application with which they interact. We do not endorse, screen or approve, and are not responsible for the privacy practices or content of such other websites or applications. Visiting these other websites or applications is at your own risk.

Boom’s Services may include publicly accessible blogs, community forums, or private messaging features. The Sites and our other Services may also contain links and interactive features with various social media platforms (e.g., widgets). If you already use these platforms, their cookies may be set on your Device when using our Sites or other Services. You should be aware that Personal Information which you voluntarily include and transmit online in a publicly accessible blog, chat room, social media platform or otherwise online, or that you share in an open forum may be viewed and used by others without any restrictions. We are unable to control such uses of your information when interacting with a social media platform, and by using such services you assume the risk that the Personal Information provided by you may be viewed and used by Third-Parties for any number of purposes.

3.7

Third-Party Partner Payment Processing

When you make purchases through the Services, we Process your payments through Third-Party Partner applications. The Third-Party Partner application may collect certain financial information from you to Process a payment on behalf of Boom, including but not limited to, your name, email address, address and other billing information.

Onward Transfer – Boom May Disclose Your Information

4.1

Information We Share

We may share your information as described in this Privacy Policy; e.g., with a Third-Party or Service Providers, to comply with legal obligations, to protect and defend our rights and property, or with your permission.

Service Providers. From time to time, we may disclose your Personal Information to organizations that perform Services. For example, to provide customer Service, deliver Products, ship items, Process credit cards, for research, marketing, Product ratings and reviews, data Processing, and to measure the use of our Sites. We will only share the Personal Information necessary for these companies to perform work on our behalf. Your Personal Information will be provided to these organizations pursuant to a written agreement that prevents them from retaining, using, or disclosing the Personal Information for any reason other than the purpose of providing Services under the instructions of Boom, and with respect to that information, to keep it secure and act in a manner consistent with the relevant principles articulated in this Privacy Policy. Compliance with Law. We may disclose your data to any competent law enforcement body, regulatory, government agency, court or other Third-Party where we believe disclosure is necessary, for example, (i) as a matter of applicable law or regulation, (ii) to exercise, establish or defend our legal rights, or (iii) to protect your vital interests or those of any other person. Boom Partners. If you have opted-in to receive direct marketing contact from a Boom Partner, Boom will disclose your Personal information to the Boom Partners. Your Personal Information will be provided to the Boom Partner only if they agree to act in a manner consistent with the relevant principles articulated in this Privacy Policy. However, Boom recommends that you review the partner’s privacy policy as their privacy practices are not monitored or controlled by Boom. Mergers and Acquisitions. We may disclose your data to a potential buyer (and its agents and advisors) in connection with any proposed purchase, merger or acquisition of any part of our business, provided we inform the buyer it must use your Personal Information only for the purposes disclosed in this Privacy Policy. If Boom is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Sites of any change in ownership.

4.2

International Data Transfers

You agree that all Personal Information collected by Boom may be transferred, Processed, and stored anywhere in the world, including but not limited to, the United States, Brazil, Australia, Singapore, or Ireland, as well as the European Union, in the cloud, on our servers, on the servers of our affiliates or the servers of our Service Providers, our group companies, and partners that may operate around the world.

If any transfer of Personal Information of residents of the European Economic Area (“EEA”) is made to a person or entity located in a country outside of the EEA that is not recognized as providing an adequate level of protection, we will provide for increased information security and appropriate contractual provisions to strengthen data protection. To ensure that any such transfers of the Personal Information of EEA residents are compliant with applicable laws, we will either (i) conclude a data transfer agreement, based upon the EU model agreements, (ii) adopt binding corporate rules, (iii) rely on legally determined exceptions (such as requesting your explicit consent), or (iv) adopt other mechanisms which have been deemed to provide for the adequate protection of your Personal Information.

4.3

Selling

We do not trade, rent, or sell your Personal Information. Although we may share your information with others, such as Agents, Service Providers, or Third-Party Partners, we only disclose the minimum amount of Personal Information necessary.

Opt-Out (Right to Object to Processing)

5.1

General

You have the right to object to and opt-out of certain uses and disclosures of your Personal Information. Where you have consented to Boom’s Processing of your Personal Information you may withdraw that consent at any time and opt-out to further Processing by contacting admin@boomcollaboration.com. Even if you opt-out, we may still collect and use non-Personal Information regarding your activities on our Sites, Services, and/or information from the advertisements on Third-Party websites for non-interest-based advertising purposes, such as determine the effectiveness of the advertisements, or use your Personal Information for legitimate business purposes including fulfillment of billing or contractual obligations, as well as legal requirements.

5.2

Email and Telephone Communications

If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt-out of receiving future emails. We will Process your request within a reasonable time after receipt. Note that you will continue to receive transaction-related emails regarding Products or Services you have requested or used.

5.3

“Do Not Track”

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

5.4

COOKIES AND INTEREST-BASED ADVERTISING

As noted above, you may stop or restrict the placement of cookies on your computer or remove them from your browser by adjusting your web browser preferences. Please note cookie-based opt-outs are not effective on mobile applications. However, on many mobile Devices, application users may opt-out of certain mobile ads via their Device settings.

You can choose not to be included in Google Analytics here.

To be clear, whether you are using our opt-out or an online industry opt-out, these cookie-based opt-outs must be performed on each Device and browser that you wish to have opted-out. For example, if you have opted-out on your computer browser, that opt-out will not be effective on your mobile Device. You must separately opt-out on each Device.

Right of Access, Rectification, Erasure, And Restriction

6.1

Your California Privacy Rights

If you are a resident of California, you have certain rights pursuant to the California Consumer Privacy Act and the Shine the Light law. Those rights are detailed in this Section 6.1. A. RIGHT TO KNOW ABOUT PERSONAL INFORMATION COLLECTED, DISCLOSED OR SOLD You have the right to request that Boom disclose the following information to you about our collection and use of your personal information in connection with the Boom’s use over the last 12 months:

The categories of personal information we collect about you.

The categories of sources for the personal information we collect about you.

Our business or commercial purpose for collecting or selling that personal information.

The categories of third parties with whom we share that personal information.

The specific pieces of personal information collected about you.

If we disclosed your personal information for a business purpose, a list of the categories of personal information we have disclosed in the prior 12 months.

If we have not disclosed your personal information in the preceding 12 months, we will disclose that upon request.

B. RIGHT TO REQUEST DELETION OF PERSONAL INFORMATION You also have the right to request that Boom delete any of your personal information that we have collected and retained. We will not delete your information if we need it to protect the security or functionality of our operations, to comply with legal obligations, or for certain other reasons.

C. PROCESS BOOM WILL USE TO VERIFY REQUEST TO DISCLOSE OR DELETE CALIFORNIA RESIDENT'S PERSONAL INFORMATION

A request to disclose or delete your information must include enough information to allow us to reasonably verify you are the person we collected personal information about, a resident of California, and it must describe your request with enough detail to allow us to properly understand, evaluate, and respond to it. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

D. SHINE THE LIGHT LAW Boom does not share your Personal Information with any Third Party for that party's direct marketing purposes.

6.2

For EEA Residents, Pursuant to the General Data Protection Regulation or Equivalent Local Legislation, you may have the following rights:

Subject Access Right. You can ask us to provide you with a copy of the Personal Information that we hold about you and a description of how we use your Personal Information.

Right to Rectification. If you believe any Personal Information we hold about you may be inaccurate or incomplete, you can ask us to rectify these inaccuracies.

Right to Erasure / Right to be Forgotten. You can ask us to erase your Personal Information in certain circumstances:

the Personal Information is no longer necessary in relation to the purposes for which it was collected and Processed;

our legal grounds for Processing is consent, you withdraw consent and we have no other lawful basis for the Processing;

our legal grounds for Processing is that the Processing is necessary for legitimate interests pursued by us or a Third Party Partner, you object to our Processing and we do not have overriding legitimate grounds;

you object to our Processing for direct marketing purposes;

your Personal Information has been unlawfully Processed; or

your Personal Information must be erased to comply with a legal obligation to which we are subject.

•Right to Data Portability. Where you have consented or have entered a contract with us, and we Process your Personal Information using automated means, you can ask us to supply that information to another party in a machine-readable format.

•Right to Restriction of Processing. You can ask us to restrict or suspend our Processing of your Personal Information in certain limited circumstances:

for a period enabling us to verify the accuracy of your Personal Information where you have contested the accuracy of the Personal Information;

your Personal Information has been unlawfully Processed and you request restriction of Processing instead of deletion;

your Personal Information is no longer necessary in relation to the purposes it was collected and Processed for, but the Personal Information is required by you to establish, exercise or defend legal claims; or for a period enabling us to verify whether the legitimate grounds relied on by us override your interests where you have objected to Processing based on it being necessary for the pursuit of a legitimate interest identified by us. Right to Object to Processing. You have the right to object to our Processing of your Personal Information in certain circumstances where we Process your information on the lawful basis of our legitimate interests when:

our legal grounds for Processing is that the Processing is necessary for a legitimate interest pursued by us; or our Processing is for direct marketing purposes. If you object, your Personal Information will subsequently no longer be used for direct marketing purposes but will be retained on a suppression list. Right to Withdraw Consent. If we Process Personal Information based on your express consent, you have the right to withdraw this consent at any time. We do not generally Process Personal Information based on express consent because we can usually rely on another legal basis. However, please note that this will not affect the lawfulness of any Processing of your information carried out before you withdraw your consent. The consents obtained are independent from each other; therefore, you can often revoke one, without affecting the others. Revoking your consent may mean that we are no longer able to provide you with the same services.

Although Boom makes good faith efforts to satisfy each request for access, rectification, and erasure, there may be circumstances in which Boom is unable to provide access to an individual’s Personal Information. If Boom determines that access should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries. In all cases, to protect your privacy, Boom will take commercially reasonable steps to verify your identity before granting access to or making any changes to your Personal Information.

We will not discriminate against you if you choose to exercise any of your rights in accordance with this Privacy Policy.

Data Retention

We retain Personal Information we collect from you where we have an ongoing legitimate business need to do so. For example, we will retain your information for as long as your account is active or as needed to provide you Services. If you wish to cancel your account or request that we no longer use your information to provide you Services, contact us at admin@boomcollaboration.com.

Please note that if you ask us to delete your Personal Information we will endeavor to comply with your request in compliance with applicable law, but we may need to retain and use some information where necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Security of Your Information

We take steps in accordance with good industry practice to protect the information, including Personal Information, we collect from you from unauthorized access, disclosure, alteration, or destruction. We do this by implementing and maintaining reasonable security procedures and practices appropriate to the nature of the Personal Information that we collect and Process about you. The measures we use are intended to provide a level of security appropriate to the risk of Processing your Personal Information.

Your data is accessed by Boom as required to support the Services and Products, and access is limited to only those within the organization with the need to access to support the Services and Products.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, Boom cannot guarantee the security of any information you transmit to us or from our Products or Services.

International Users

By using a Site, Boom will transfer the data of international users to the United States. Other Rights and Important Information

12.1

Changes to Boom’s Privacy Policy and Practices

This Privacy Policy may change from time to time. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you use the Sites or Services after the updated Privacy Policy is posted on the Site. Please note that if we make any material changes to this Privacy Policy, we will post a notification and a link within the Site so you may review the updated Privacy Policy. If at any point you do not agree to any portion of the Privacy Policy then in effect, you must immediately stop using the Sites and Services.

Definitions

The following capitalized terms shall have the meanings herein as set forth below.

“Agent,” “Service Provider,” or “Third-Party Partner” means any company, natural or legal person, public authority, agency or body that Processes Personal Information pursuant to the instructions of, and solely for, Boom or to which Boom discloses Personal Information for use on its behalf, and who has a written contract with Boom.

“Controller” means the business, natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the Processing of Personal Information; where the purposes and means of such Processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

“Device” means any physical object that is capable of connecting to the Internet, directly or indirectly, or to another device.

“Personal Information” means any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a natural person (“Individual”), household, or device.

“Process,” “Processing,” or “Processed” means any operation which is performed upon Personal Information, whether or not by automatic means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.

“Processor” means a natural or legal person, public authority, agency or other body that processes Personal Information on behalf of a Controller, and pursuant to the Controller’s instructions.
